  2. Your application will be processed through a licensed insurance agent or intermediary. spainvisahealthinsurance does not underwrite or issue insurance policies. Its role is strictly limited to digital marketing activities and assisting with customer queries for the Spain Visa Health Insurance platform, which is developed and distributed by spainvisahealthinsurance through its contractual arrangements in Spain.If your application is accepted by the insurer, customer payments will be collected by us and subsequently remitted to the licensed intermediary.You have the right to withdraw from the policy within 14 days, provided that the policy coverage has not already commenced.Policy cancellations due to visa rejection may be eligible for a refund upon submission of appropriate supporting documentation.All personal data is processed in accordance with GDPR regulations.Refunds, where applicable, are subject to administrative and payment gateway charges.

    For the purposes of these Terms and Conditions, the following definitions shall apply:

  4. SpainVisaHealthInsurance refers to Spain Visa Health Insurance Private Limited, operating as a licensed distributor of the Spain Visa Health Insurance technology platform (developed by spainvisahealthinsurance), and providing digital marketing and technology support services.
  5. Licensed Insurance Distributor refers to any individual and/or legal entity duly authorised and registered to distribute insurance products in accordance with applicable laws and regulations.
  6. Customer refers to any natural person who uses the platform for purposes that are not primarily related to their trade, business, or profession.
  7. Insurance Provider means the insurer that underwrites the insurance policy, as selected and contracted directly by the Customer.
  8. Service Fee means the partially refundable fee payable to Spain Visa Health Insurance Private Limited (as specified in Section 4.2) for application support services, query assistance, and facilitation of connection with the Licensed Insurance Distributor.
  9. Insurance Premium means the amount payable to the Licensed Insurance Distributor or the Insurance Provider for the insurance coverage selected by the Customer.
  10. Website means https://spainvisahealthinsurance.com and any successor URL.

  11. 3. Scope of Application

Unless otherwise expressly stated, these General Terms and Conditions of Spain Visa Health Insurance Private Limited shall apply to all offers made by SpainVisaHealthInsurance in relation to applications for health insurance and assistance products listed by its licensed partners on the online purchase website https://spainvisahealthinsurance.com. Through the Website, customers may review various health insurance and assistance products offered by different insurance companies and submit applications online. These General Terms and Conditions apply exclusively to customers who qualify as consumers. A consumer is defined as any natural person who enters into a legal transaction for purposes that are not primarily related to their commercial or professional activity.

    spainvisahealthinsurance operates solely as a technology and digital marketing service provider for licensed insurance intermediaries, distributing the Spain Visa Health Insurance platform developed by Spain Visa Health Insurance Private Limited. We do not act as an insurance broker, insurer, or policy administrator, and we do not underwrite insurance policies or guarantee acceptance of any application. All insurance contracts are concluded directly between the customer and the licensed intermediary and/or insurer.

    For matters relating to regulatory compliance or licensing requirements, customers should contact the relevant licensed intermediary directly. In the event of any claim, dispute, or policy-related issue, customers must communicate directly with the licensed intermediary, as specified in these Terms and Conditions.

  15. 5. Role of SpainVisaHealthInsurance & Licensed Distribution Partners
  16. SpainVisaHealthInsurance does not underwrite, issue, administer, or manage any insurance products, nor does it provide insurance advisory services. All insurance-related activities — including but not limited to application processing, premium collection, issuance of policy documentation, claims handling, underwriting decisions, and provision of product advice — are carried out exclusively by duly licensed insurance distributors and/or insurers. SpainVisaHealthInsurance operates solely as a technology platform and digital marketing service provider, facilitating connections between customers and licensed insurance distribution partners.

  17. 6. Insurance Contract
  18. SpainVisaHealthInsurance provides customers with free, non-binding information regarding insurance rates, terms, and conditions.
  19. SpainVisaHealthInsurance uses its online application portal to facilitate and support health insurance applications submitted through the Spain Visa Health Insurance platform.
  20. After selecting a health plan, the Customer initiates the application process by clicking the payment button. Upon receipt of the applicable Service Fee, SpainVisaHealthInsurance provides application support services.
  21. SpainVisaHealthInsurance assists Customers in completing the required application forms, which are subsequently forwarded to the relevant licensed intermediary.
  22. The insurer alone has the sole discretion to accept or reject the Customer’s application.
  23. If the proposal is approved, the Customer must pay the Insurance Premium directly to the insurer or licensed intermediary.
  24. Where SpainVisaHealthInsurance’s payment gateway is used, funds may be temporarily collected and subsequently transferred to the licensed distribution partner.
  25. Customers are solely responsible for verifying the accuracy of all information prior to making payment, including but not limited to spelling, dates of birth, travel dates, and the selected policy period.
  26. Restrictions may apply to modifications of the insurance period. Customers are required to review all policy terms and conditions carefully before proceeding.
  27. After payment of the Service Fee, the completed application form must be submitted to support@spainvisahealthinsurance.com.
  28. Insurers may require up to fifteen (15) days to issue the policy following receipt of the Insurance Premium.
  29. SpainVisaHealthInsurance retains only data necessary for contract coordination purposes. Personal data is deleted after the underwriting decision, except for minimal records required to comply with applicable legal and regulatory obligations.

  30. 7. Payment, Prices and Invoicing
  31. Service Fee payments are processed via PayPal or other approved online payment methods made available on the Website.
  32. Payment Structure
    1. 1. Service Fee: A Service Fee of up to thirty percent (30%) may be included in the final displayed price. This fee covers the provision of online platform access, application support services, query resolution assistance, and general claims coordination support. Spain Visa Health Insurance Private Limited does not provide insurance advice or act as an advisor in relation to any insurance contract.
    2. 2. Premiums: Insurance Premiums are payable directly to the licensed intermediary or insurer. Where the SpainVisaHealthInsurance payment gateway is used, the Premium may be temporarily collected and subsequently transferred to the relevant licensed distribution partner.
    3. If the application is rejected by the insurer:

The Service Fee, Insurance Premium (if already transferred), and any applicable PayPal transaction or processing fees are non-refundable by Spain Visa Health Insurance Private Limited.When making payment via PayPal, the payment transaction is processed by PayPal in accordance with its own terms and privacy policy. Necessary payment data is shared with PayPal solely for the purpose of processing the transaction. Failure to provide the required payment information may result in the inability to complete the transaction and process the application.

    All PayPal transaction and processing fees are non-refundable under any circumstances.

    All prices are stated in Euros (€) and are inclusive of applicable taxes, unless otherwise specified.

    No contradictory national laws

    Customers are solely responsible for ensuring that they are legally permitted to purchase health insurance products outside their country of residence or nationality. Spain Visa Health Insurance Private Limited does not verify or guarantee compliance with the laws or regulations of the Customer’s home country or any other jurisdiction.

    Insurance products made available through the Website are not offered to residents of:

    1. Countries subject to European Union (EU), United States (U.S.), or other applicable international sanctions;

    2. Jurisdictions where the purchase of cross-border insurance products is prohibited by law;

    3. Any region where the distribution of such insurance products would violate applicable legal or regulatory requirements.

    Licensed distribution partners reserve the right to cancel, void, or refuse policies that are found to be in violation of this clause or applicable sanctions and regulatory restrictions.

    Anti-Money Laundering (AML) & Know-Your-Customer (KYC)

    All Anti-Money Laundering (AML) and Know-Your-Customer (KYC) checks are conducted exclusively by the licensed insurance distributor and/or insurer in accordance with applicable legal and regulatory requirements.Spain Visa Health Insurance Private Limited does not perform AML or KYC verification on behalf of insurers. Customers must contact the relevant Licensed Insurance Distributor directly for any queries, documentation requests, or matters relating to AML/KYC procedures.

    Product Pricing

    Spain Visa Health Insurance Private Limited makes reasonable efforts to ensure that all insurance rates and product information displayed on the Website are accurate and up to date at the time of publication. However, we do not guarantee the completeness, accuracy, or ongoing availability of any pricing information. Final pricing, underwriting decisions, and policy terms are determined solely by the licensed distributor and/or insurer. Customers are responsible for independently assessing the suitability of the selected insurance product and for evaluating the financial standing and risk profile of the respective insurance provider before entering into any insurance contract.

    Rejected Application & Cancellation

    Customers may cancel the service contract in accordance with the applicable insurer’s policy terms and conditions. All cancellation requests must be submitted in writing via email to support@spainvisahealthinsurance.com. If a visa application is officially rejected, the Customer may apply for policy cancellation within ten (10) days from the date of the official rejection notice by submitting a copy of the visa rejection letter.

    Refund Calculation (Visa Rejection Cases)

    Where applicable, the refund amount shall be calculated as follows:
    Refund Amount = Insurance Premium Paid – (€50 administration fee + 4% transaction charges) – any non-refundable service costs
    Refunds will be processed within ten (10) business days after receipt and verification of the required documentation. Spain Visa Health Insurance Private Limited reserves the right to adjust or reduce applicable charges on a case-by-case basis, depending on the merits of the individual situation.

    Service Fee Refund (If Insurer Rejects the Application)

    If the insurer rejects the Customer’s application before policy issuance, the Service Fee refund shall be calculated as follows:
    Service Fee Refund = Service Fee Paid – PayPal transaction fees – €50 administrative charge
    All PayPal processing fees are non-refundable.

  34. Liability of Spain Visa Health Insurance Private Limited
  35. Any exclusions or limitations of liability set out in these Terms and Conditions shall also apply to the employees, directors, agents, contractors, and authorised representatives of Spain Visa Health Insurance Private Limited.

    Spain Visa Health Insurance Private Limited shall not be liable for:

    • a)The suitability, adequacy, or appropriateness of any insurance product;
    • b)Any underwriting decision made by the insurer;
    • c)Rejection of a visa application;
    • d)The accuracy, completeness, or performance of insurance coverage provided by the insurer or licensed intermediary;
    • e)Any claims handling decisions or policy servicing matters.

    Liability of Spain Visa Health Insurance Private Limited shall be limited exclusively to direct damages caused by proven gross negligence or wilful misconduct. In all cases, liability shall not exceed the total Service Fee paid by the Customer.

    All matters relating to insurance contracts, coverage, claims, policy servicing, or disputes are strictly between the Customer, the insurer, and the licensed intermediary.

    The Customer agrees to indemnify and hold harmless Spain Visa Health Insurance Private Limited, its officers, employees, and representatives from any claims, losses, damages, liabilities, or expenses arising out of or related to the insurance contract or insurer decisions.

  36. Links to Third-Party Websites
  37. The Website may contain links to third-party websites for informational or convenience purposes. Spain Visa Health Insurance Private Limited does not control, endorse, or assume any responsibility for the content, accuracy, privacy practices, or availability of such third-party websites.
    Accessing third-party websites is at the Customer’s own risk. Spain Visa Health Insurance Private Limited shall not be liable for any loss or damage arising from the use of or reliance on content, products, or services available on external websites.

  38. Data Protection
  39. Roles & Legal Basis

    Spain Visa Health Insurance Private Limited acts as a Data Processor under the instructions of the Licensed Insurance Distributors, who act as the Data Controllers.
    Personal data is processed solely for the purpose of facilitating insurance applications, coordinating policy issuance, and providing related support services.
    The legal basis for processing personal data is Article 6(1)(b) of the General Data Protection Regulation (GDPR), namely the performance of a contract or the taking of steps at the request of the data subject prior to entering into a contract.

    International Transfers & Safeguards

    Personal data may be transferred to Singapore or other jurisdictions outside the European Economic Area (EEA) where necessary for service delivery. Such transfers are carried out using appropriate safeguards, including the European Commission’s Standard Contractual Clauses (SCCs), to ensure an adequate level of data protection.
    By accepting these Terms and Conditions, the Customer acknowledges and consents to such international data transfers in accordance with applicable data protection laws.

    Your Rights

    In accordance with applicable data protection laws, including the GDPR, you have the right to:

    1. Access your personal data;

    2. Request rectification of inaccurate or incomplete data;

    3. Request deletion of your personal data, subject to legal retention obligations;

    4. Restrict or object to the processing of your personal data under certain circumstances.

    Data Retention

    Temporary personal data shall be deleted within thirty (30) days or upon finalisation of the contract decision, whichever occurs earlier. Contractual and compliance-related records shall be retained for a period of three (3) years before secure deletion or anonymisation in accordance with applicable legal requirements.

  40. Force Majeure

Spain Visa Health Insurance Private Limited shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, labour disputes, cyber-attacks, system failures, governmental actions, regulatory changes, pandemics, or other unforeseen circumstances.

  42. Amendments
  43. These Terms and Conditions may be updated or amended at any time. Customers will be provided with at least fourteen (14) days’ prior notice via email or publication on the Website. Continued use of the services after such notice constitutes acceptance of the updated Terms.

  44. Applicable Law & Dispute Resolution
  45. Insurance-related disputes, including matters relating to policy coverage, underwriting, claims, or premium refunds, shall be governed by the applicable laws of the insurer’s jurisdiction and must be directed exclusively to the licensed intermediary or insurer.

    Any dispute relating solely to the services provided by Spain Visa Health Insurance Private Limited shall be governed by the laws of Singapore.

    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain fully enforceable.

  46. Non-Refundability of Part Payment

Once the licensed intermediary or insurer issues the policy, any payment made to Spain Visa Health Insurance Private Limited shall be deemed fully earned and non-refundable, regardless of any subsequent cancellation or termination. Any premium refund, where applicable, shall be handled solely by the insurer in accordance with its policy terms.

  48. Miscellaneous Clause
  49. 1. No Advice
    Spain Visa Health Insurance Private Limited does not provide insurance advice. Customers must consult the relevant licensed intermediary before entering into any insurance contract.
    2. Service Fees
    Service fees may be up to thirty percent (30%) of the total displayed amount and relate solely to platform access and support services.
    3. Policy Accuracy
    Premium quotations displayed on the Website are indicative estimates only. The final premium and coverage terms are subject to evaluation and approval by the insurer.
    4. Claims Liability
    Spain Visa Health Insurance Private Limited is not involved in claims processing, assessment, or settlement decisions.
    5. Right of Withdrawal
    Customers may withdraw within fourteen (14) days, provided that insurance coverage has not commenced. Any applicable refund shall be calculated as: Service Fee paid minus payment gateway charges, administrative fees, and the value of services already rendered.
    6. Cookies & Tracking
    The Website uses cookies and similar technologies for analytics, functionality, and marketing purposes. Non-essential cookies may be declined through browser settings or cookie preference tools.
    7. Entire Agreement
    These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements or understandings.
    8. No Reliance
    The Customer acknowledges that they have not relied upon any representations, statements, or promises not expressly set out in these Terms.
    9. Notices
    All notices must be sent via email to support@spainvisahealthinsurance.com. Notices shall be deemed received two (2) business days after transmission.
    10. Assignment
    The Customer may not assign or transfer any rights or obligations under these Terms without prior written consent. Spain Visa Health Insurance Private Limited may assign its rights and obligations to affiliates, successors, or related entities.
    11. Insurer Terms
    All insurance contracts are subject to the respective insurer’s policy terms and conditions, which shall prevail in the event of any inconsistency relating to coverage, benefits, exclusions, or claims.
